Terms & Conditions

By accessing or using any services provided by Abi Computers — including our website, hosting, software products, POS systems, and support services — you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

If you are accepting these terms on behalf of an organisation, you represent that you have the authority to bind that organisation. If you do not agree with these terms, please do not use our services.

• You must be at least 18 years of age to create an account and use our services
• You agree to provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately at support@abicomputers.co.ke if you suspect unauthorised use of your account
• Abi Computers will not be liable for any loss resulting from unauthorised use of your account

You agree to use our services only for lawful purposes. You must not:

• Use our services to distribute malware, spam, or any harmful content
• Attempt to gain unauthorised access to our systems or other users' accounts
• Use our hosting services to host illegal content, pirated software, or phishing sites
• Reverse-engineer, decompile, or resell any software we provide without written consent
• Use automated tools to scrape, crawl, or excessively load our servers
• Impersonate Abi Computers, our staff, or any other entity

• All transactions are processed via M-Pesa, bank transfer, or card. By initiating payment, you confirm the amount and service selected
• Prices are quoted in KES or USD as displayed on the relevant service page and are subject to change with 7 days' notice
• Payments are generally non-refundable once a service has been activated. Refund requests must be submitted within 48 hours of purchase for consideration
• Domain registrations and hosting renewals are the client's responsibility. Abi Computers will send renewal reminders but is not liable for expired services
• Recurring services (hosting, support plans) auto-renew unless cancelled in writing before the renewal date
• Disputed payments must be raised within 14 days of the transaction

All content, branding, logos, software, and materials on the Abi Computers platform are the intellectual property of Abi Computers or its licensors. You may not reproduce, distribute, or create derivative works without explicit written permission.

PHP scripts and software systems sold through our store are licensed for use — not transferred as intellectual property. The licence terms for each product are specified at point of purchase.

We target a 99.9% uptime SLA for all hosting services. Scheduled maintenance will be communicated at least 24 hours in advance. Unplanned outages will be addressed as a priority.

Abi Computers is not liable for service interruptions caused by:

• Events beyond our reasonable control (force majeure)
• Third-party service failures (e.g. data centre power, Safaricom network)
• Client-side misconfigurations or malware introduced by the client

To the maximum extent permitted by applicable law, Abi Computers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Loss of data, revenue, or business opportunities
• Errors, interruptions, or delays in our services
• Unauthorised access to your account or transmitted data

Our total cumulative liability to you shall not exceed the amount you paid to us in the 30 days preceding the event giving rise to the claim.

Either party may terminate the service relationship at any time:

• By you: Cancel your account or service at any time from your dashboard or by contacting us
• By us: We may suspend or terminate your access immediately if you violate these terms, engage in fraudulent activity, or pose a security risk

Upon termination, your access to paid services ceases and data may be deleted after a 14-day grace period. You remain liable for any outstanding charges.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

We encourage resolution of disputes through direct communication before initiating legal proceedings. Contact us first at support@abicomputers.co.ke.

We reserve the right to modify these Terms at any time. Material changes will be communicated to registered users via email at least 14 days before taking effect.

Your continued use of our services after the effective date of any revision constitutes acceptance of the updated Terms. If you do not agree to the changes, you must discontinue use of our services.
